Ban stock trading by members of Congress through House and Senate rules

Members of Congress can still own and trade individual stocks. In July 2026 the House passed a partial ban, 232 to 198. On Sept. 30 the Senate fell seven votes short of the 60 needed to take it up. Every bill that has not become law dies on Jan. 3, so the new Congress has to start over. On Nov. 4, Hakeem Jeffries told House Democrats a ban on members trading stocks is part of their agenda.

What's at stake: The House can ban its own members from trading through the rules it adopts in its first days in January, by simple majority and with no signature from the president. A law covering both chambers, the president and the vice president needs Trump to sign it or two-thirds of both chambers to override a veto.

Next: House votes on its rules for the new Congress

57 days away. Countdown starts at 7.

Our position:For

For a full ban on stock trading by members of Congress. Against the House bill as written.

Members of Congress write the laws that move markets and get briefings the public never sees. Owning and trading individual stocks lets them profit from that, or look like they do. Polls find about 86 percent of Americans support a ban, across parties.

What the House bill got right: In July 2026 the House passed the Stop Insider Trading Act, the first time a full chamber of Congress has voted to ban lawmaker stock trading. It covered spouses and dependent children.

What it got wrong: It only stopped new purchases, so members could keep every stock they already own and the conflicts that come with them. It carried a voter ID rider that had nothing to do with stocks. Rep. Thomas Massie, a Republican, said the rider was added to get Democrats to vote against the ban so it could be used in the November election. It also left out the president and vice president. That is why most House Democrats voted no, and why it failed in the Senate.

What we want instead: members, their spouses and dependent children sell their individual stocks or place them in a qualified blind trust. The ban covers crypto and the president and vice president. Breaking it carries real penalties. And it passes as a standalone bill with no unrelated riders.

How to get it done with Trump in office: Trump has said he would sign a ban, but he attacked Sen. Josh Hawley when Hawley’s bill covered the president. So we push on three tracks. First, the House adopts a ban for its own members in its January rules package, which needs no signature from the president. Second, the Senate adopts Sen. Ossoff’s rule banning senators from trading stocks and crypto. Third, Congress passes a full law by margins wide enough that a veto would be costly, and holds Trump to his word on the record.

Will the House rules adopted in January ban members from trading stocks?

PATH AToss-up

If Democratic leaders put the ban in the rules package...

...it passes with Democratic votes alone and House members have to stop trading, with no Senate vote and no signature from the president.

Why: Democrats hold at least 228 seats, so they can lose about 10 of their own and still pass it. Jeffries listed a ban on members trading stocks in his Nov. 4 letter to House Democrats. He has not said whether it goes in the rules or in a bill.

Watch: Jeffries or the Rules Committee says the ban is in the package. Members sign a letter asking for it. The text of the rules package is posted before Jan. 3.

PATH BToss-up

If leaders leave it out of the rules to pass one law covering Congress and the executive branch...

...the House can pass that bill, but it only becomes law with 60 Senate votes and a signature from Trump on a ban that covers him, or a veto override by two-thirds of both chambers.

Why: Jeffries has backed a ban that also covers the president and vice president. In September 2026 a stock trading bill fell seven votes short of the 60 needed in the Senate, and Democrats will hold about 54 seats.

Watch: Leaders say they want a single law instead of a House rule. The bill backed by Jeffries is reintroduced in January.

Vote math

If every Democrat without a clear no votes for a ban in the House rules, that is 228 votes. That clears the 218 needed.

  • Said yes: 7
  • Nothing public, assumed yes: 221
  • Undecided / conditions: 0
  • Clear no: 0
  • Other members: 207

For the no votes to matter, they have to push the yes votes below the line. That takes 11 Democrats voting no, or 21 voting “present.”

Assumes all 435 members vote and every other member votes no. It passes with more yes votes than no votes, so “present” votes lower the bar. Seats won: at least 228 as of Nov 4, 2026 (wftv.com). Some races are still being counted.
